Proexperty Ltd - Terms & Conditions

By booking accommodation with Proexperty Ltd (“Proexperty Stays”), you agree to the following terms and conditions:

1. Booking

1.1. Your booking is with Proexperty Ltd., a company registered in England and Wales (Company No. 15793885). The head office is located at Proexperty Ltd, 6 Duddell Road, Stoke-on-Trent, ST6 1LN.

1.2. “You” or “Your” refers to the individual or organisation making the booking with Proexperty Stays.

1.3. These terms apply to all bookings made through the Proexperty Stays website (www.ProexpertyStays.com), via email (Enquiries@ProexpertyStays.com), by phone, or in person with Proexperty Stays. Bookings made through third-party platforms like Booking.com, Airbnb, OpenRent or VRBO are also subject to these terms, though the terms of the third-party platform will take precedence in case of a dispute. Availability cannot be guaranteed at the time of sending an email inquiry.

1.4. Your booking is confirmed and a legal contract is established once payment is successfully made. No booking is confirmed if payment is declined or unauthorised.

1.5. The booking is for short-term stays for leisure, business, or temporary purposes and does not create an assured shorthold tenancy or lease. It is an excluded agreement under s.3A(7)(a) of the Protection from Eviction Act 1977.

1.6. Bookings can range from one night to 6 months. Any booking longer than six months requires approval from the company director. Bookings can be made up to 9:00 PM on the first night of stay.

1.7. Bookings can only be made by individuals aged 18 or older, and at least one guest aged 18 or above must stay in the accommodation.

1.8. You may not resell or transfer your booking without the express consent of Proexperty Stays.

2. Payment and Cancellations

2.1. Payments can be made via credit or debit card, or bank transfer. No additional fees are charged for bookings or card payments. Payments made by phone can be done as follows:

2.1.1. Credit/debit card payments are preferred for online bookings via https://ProexpertyStays.com.

2.1.2. Bank transfer (BACS) is preferred for phone bookings, with payments made to:

* Bank: Natwest

* Reference: Guest’s surname + check-in date (e.g., SMITH01092024 for Martin Smith, 1st September 2024).

Cash or cheque payments are only accepted in exceptional circumstances and require prior approval. Post-dated cheques are not accepted.

2.2. Full payment is required upon booking unless otherwise agreed or if payment is made through another platform.

2.3. The total price for your stay will be presented before you confirm your booking. Pricing is dynamic, and fluctuations in price after booking do not affect the agreed-upon amount.

2.4. For direct bookings through Proexperty Stays website, phone or email the cancellation policy is as follows.

To receive a full refund, you must cancel any bookings within 24 hours of making the reservation. If not cancelled within 24 hours, to receive a full refund the following conditions apply:

For stays up to 7 days, cancel at least 7 days before check-in.

For stays up to 14 days, cancel at least 14 days before check-in.

For stays longer than 14 days, cancel at least 28 days before check-in.

Cancellation policies for booking through other sites such as Airbnb, booking.com, and Vrbo will be different and they will take precedence.

Please note a small cancellation processing fee may apply.

2.5. Proexperty Stays reserves the right to cancel bookings within 5 days of the start date due to reasons beyond their control or in the event of an overbooking. In such cases, a full refund will be issued.

3. Your Stay

3.1. Check-in is from 3:00 PM, and check-out is by 11:00 AM unless otherwise agreed. Additional fees may apply for early check-in or late check-out.

3.2. Proexperty Stays provides serviced accommodation and does not offer meals or newspapers.

3.3. Your room/apartment includes one set of linen and towels (with a mid-stay change for stays over 7 nights). For longer stays I.e. 1 month+ fortnightly clean will be carried out. Additional cleaning services are available upon request which will incur a charge.

3.4. You are responsible for the behavior of all guests staying in the accommodation and ensuring they comply with these terms. Specifically, you and your guests must not:

Smoke inside the premises.

Bring pets, except assistance dogs or unless agreed by Proexperty Stays.

Bring hazardous materials, illegal substances, or engage in unlawful activities.

Tamper with fire alarms or emergency equipment.

Remove, damage, or destroy Proexperty Stays property.

Download or access unlawful or obscene material using Proexperty Stays’ technology.

Cause disturbances, especially after 10:00 PM.

Fail to return keys/fobs/cards at check-out.

Use extra linen from locked cupboards without permission.

Charge an electric car using the main power supply without prior arrangement (additional charges apply).

4. Damage, Theft, and Costs

4.1. Proexperty Stays reserves the right to charge your credit/debit card for:

4.1.1. The cost of replacing or repairing Proexperty Stays property damaged during your stay.

4.1.2. The cost of replacing any stolen items.

4.1.3. A standard charge of £1000 for breaching the non-smoking policy, with additional charges if damage occurs.

4.1.4. A standard charge of £1000 for evidence or suspicion of illegal substance use, with additional charges if necessary.

4.2. These costs may be charged at check-out or later if necessary.

4.3. If Proexperty Stays is unable to charge your card, an invoice will be sent, which you agree to pay within 14 days.

4.4. A receipt and breakdown of costs will be provided for any additional charges.

4.5. Additional charges include:

* Lost keys/apartment fob– £150.00

* Lost car park fob – £150.00

* Lost parking permit – £100.00

* False emergency call-out (outside working hours) – £150.00

* Excessive cleaning – £30.00 per hour

* Noise complaints/disruptive behavior – £100.00

* Inappropriate items flushed down the toilet – £150.00

* Early check-in (before 3:00 PM) – £10/hr

* Late check-out (after 11:00 AM) – £10 / hour

* Damage to items/decor/furniture – assessed on a case-by-case basis

* Extra linen – £50.00

4.6. A refundable damage deposit of £200 will be taken at the time of booking. This will be reimbursed within 3-5 working days of check-out, subject to a satisfactory property inspection.

4.7. By agreeing to these terms, you consent to this policy.

5. Privacy, Data Protection, and Security

5.1. Proexperty Stays processes your information according to their privacy policy. By providing this information, you consent to its use and confirm its accuracy.

5.2. By law, Proexperty Stays must maintain a register of all guests’ names and nationalities for 12 months. Non-British/Irish/Commonwealth guests must provide passport details and next destination information.

5.3. For details on data collection, use, and storage, refer to Proexperty Stays’ privacy policy.

5.4. Proexperty Stays uses Stripe (www.stripe.com/gb) to process payments securely. No card details are stored by Proexperty Stays.

5.5. Security cameras/audio recording devices monitor the entrance of the property. Guests are informed of this at the time of booking.

5.6. Noise monitoring devices are used to ensure compliance with noise regulations. These devices do not record sound.

6. Complaints

6.1. Proexperty Stays strives to ensure an enjoyable stay.

6.2. If an issue arises during your stay, please contact a staff member for assistance.

6.3. If the issue cannot be resolved informally, you may submit a formal complaint in writing. Include as much detail as possible for proper investigation.

6.4. A management team member will handle your complaint, aiming to respond within 2 days.

6.5. Proexperty Stays reserves the right to reject complaints made in bad faith.

7. Limitation of Liability

7.1. Proexperty Stays liability to you is limited to the total value of your booking, except where the Hotel Proprietor’s Act 1956 applies.

7.2. Proexperty Stays is not liable for any consequential or indirect losses, including loss of profit, data, or goodwill.

7.3. Proexperty Stays is not responsible for items left behind, lost, or damaged during your stay.

7.4. Proexperty Stays cannot be held liable for failure to fulfill the contract due to events beyond their control (e.g., flood, fire, acts of terrorism, labour disputes).

8. Severability

8.1. If any provision of these terms and conditions is determined to be invalid, illegal, unenforceable, or in conflict with the law of any jurisdiction, the validity, legality, and enforceability of the remaining provisions will remain unaffected.

9. Waiver

9.1. A party’s failure to enforce any provision or seek a remedy under these terms and conditions at any time does not waive their right to enforce the provision or seek a remedy later. A waiver of any breach shall not be considered a waiver of any subsequent breach. Any waiver must be in writing and signed by the party against whom the waiver is being enforced.

10. Entire Agreement

10.1. These terms and conditions represent the entire agreement between the parties, superseding all prior communications, understandings, and agreements, whether oral or written, related to the subject matter herein.

11. Guest Obligations

11.1. The Guest has the right to occupy the property for the duration specified in their booking confirmation. The Guest agrees to the following:

11.2. Under no circumstances should overnight accommodation be provided for anyone other than those declared to Proexperty Stays and notified in advance. Visitors may not stay overnight without prior written consent from a Proexperty Stays representative.

11.3. The Guest will cover any losses or damage to the property caused during their stay.

11.4. The Guest will take good care of the property and leave it in a clean and tidy condition at the end of their stay.

11.5. The Guest will allow reasonable access to the property by the Owners and Proexperty Stays. No cots are provided in the properties.

11.6. The Guest will not cause annoyance or become a nuisance to neighboring occupants:

11.6.1. The Guest will not cause noise disturbances between 10:00 PM and 7:00 AM.

11.6.2. The Guest will not smoke in the property except communal areas such as the property’s garden.

11.6.3. Before bringing pets, the Guest will confirm with Proexperty Stays if the property is pet-friendly.

11.6.4. The Guest will read any safety notices and advice upon arrival.

11.6.5. The Guest will not re-let or sublet the property to any other group or party.

11.6.6. The Guest will use the property strictly for residential purposes.

11.6.7. The Guest will not use the property for parties or gatherings. If it is suspected that the Guest intends to use the property for such an event, entry may be refused or Guest will be removed from the premises.

11.6.8. The Guest will not use the phone or fax line connected to the property.

11.6.9. The Guest will not light any fires or candles in the property.

11.6.10. The Guest will not run a business from the property.

11.6.11. The Guest will not host a party. A violation of this rule will result in a £1,000 charge.

11.6.12. The Guest will not hang or place wet or damp articles of washing on any room heater.

11.6.13. The Guest will not make the property their permanent residence.

11.6.14. The Guest will not use more linen than supplied unless confirmed with Proexperty Stays guest services.

11.6.15. The Guest will not engage in any illegal activity on the premises.

11.7. If the Guest breaches these terms and conditions, they may be required to leave the property immediately without a refund.

11.8. The Guest must provide the full names of all individuals staying at the property and may be required to present a valid photo ID for each individual. Unauthorized occupancy will result in a £200 charge, and the relevant authorities will be informed.

11.9. The Guest must ensure that the property is not occupied by more people than stated in the booking confirmation. Proexperty Stays reserves the right to refuse entry if this condition is likely to be breached. No refunds will be issued in such cases.

11.10. In case of an emergency, the Guest should:

11.10.1. Use the fire blanket and/or fire extinguisher if appropriate.

11.10.2. Leave all belongings and exit swiftly through the main exit, ensuring that all individuals requiring assistance are brought to safety.

11.10.3. Wait on the main road away from the building and contact emergency services by calling 999, providing your location.

11.11. By signing this agreement, the Guest acknowledges that they are not protected under the Protection from Eviction Act 1977.

12. Third-Party Rights

12.1. Nothing in this Agreement is intended to, nor shall, confer any rights on a third party unless expressly provided otherwise.

13. Jurisdiction

13.1 This Agreement shall be governed by English law, with the courts of England and Wales having exclusive jurisdiction over any disputes arising from this Agreement.
